Acceptance of Terms and Conditions
This website is for GrayMatters Psychological and Consultancy, Inc. maintained and operated by our licensed mental health professionals for your individual use and viewing. Registration, access, and use of our site indicate that you accept our Terms and Conditions. Throughout this document, the terms “we”, “us”, and “our” refer to GrayMatters Psychological and Consultancy, Inc. and the terms “you, and “your” refer to you, our client.
By registering on our website, you are hereby acknowledging that you have received authorization from us to do the following:
- Use our online learning modules for education purposes
- Take our digital assessments
- Receive mental health consultation or online counseling from licensed personnel
Registration of personal accounts is free, but the use of our services requires individual payments through the use of debit/credit cards, bank transfers, e-wallets, or PayPal. If the company or organization that you work in is a partner of GrayMatters Psychological and Consultancy, Inc., you can register an online account using your company credentials and access our services without a personal cost.
Also, by registering on our website, you are agreeing to the following terms and conditions:
Audio and video counseling
- We are not responsible for any outcomes arising from the inherent limitations of audio or video sessions compared to in-person sessions. These limitations may include restricted access to nonverbal cues (such as body language, facial expressions, reactions, and hand gestures) and the inability to provide immediate physical support in emergency situations. Additionally, we cannot guarantee privacy in the client’s chosen environment during online sessions.
Payment
- For personal accounts, you will pay the appropriate fees published in our website.
- Fees for the sessions are non-refundable but sessions may be rescheduled with at least 48 hours prior notice. A rescheduling fee/no-show fee of Php 500 (1st offense), Php 750 (2nd offense), and Php 1,000 (3rd offense) will be applied if rescheduling or cancellation notice was made less than 48 hours before the scheduled session.
- Fees may change without prior notice.
Data Privacy
We uphold the strictest confidentiality as possible when handling your data and information. All personal data that we collect from you complies with Philippine laws such as RA10173 Data Privacy Law, RA 11036, Mental Health Law, RA10029 Psychology Law, and the Code of Ethics of Philippine Psychologists. We adhere to the highest ethical standards and the practice of professional psychology in the Philippines. Hence, we will manage all records and information collected with the strictest confidentiality. The personal data we collect will be held as an electronic record on data systems managed by GrayMatters Psychological and Consultancy, Inc., or as a paper record for a period of 5 years. The records and information are only seen by our staff who need these personal data so they can do their job. However, we have the right to break confidentiality when you meet one or more of the conditions listed below:
- When there is a serious, known, foreseeable harm to yourself, your dependent, or others;
- When instances of abuse, in any form, is being committed against a vulnerable person (e.g. children, elderly, employee, mentally ill etc.) and is revealed by yourself or your dependent;
- When a court order is issued or when the release is required by law;
- When you have authorized the release of your records or information through written or verbal form.
As part of our advocacy in advancing mental health care in the Philippines, your data will also be used for research purposes. In doing so, all identifying information that may directly relate to your identity will be removed and your data will be analyzed in aggregate with other data. By accepting our Terms and Conditions, you are hereby granting us authority to use your data for research, training, and educational purposes.
Intellectual Property
The name, images, logos, online learning modules, digital assessments, and any other contents of this site are propriety marks of GrayMatters Psychological and Consultancy, Inc. Copying any of these is not permitted and is illegal without prior approval from us.
General
These Terms and Conditions shall be governed by and construed in accordance with the laws of The Republic of the Philippines. Any dispute under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Philippines. Please direct any queries via our Contact Us page.
Upon accepting these Terms and Conditions, a copy of this document will be sent to your email address.
Amendments to the Terms and Conditions
